San Marino has made rules, manuals and technical guidance on electronic invoicing available to businesses and professionals ahead of the new system’s entry into force. Following the Congress of State’s resolution setting out the timeline and procedures for the mandatory electronic invoicing requirement for San Marino’s economic operators, the relevant regulatory and technical documentation on e-invoicing has now been published online.
The Department of Finance and Budget has also distributed the material to interested operators, working through professional associations and trade bodies. The goal is to provide the necessary tools well in advance so that businesses can prepare for the change.
The timeline includes an initial voluntary phase: from 1 October it will be possible to opt into the new system, while the decisive shift comes on 1 January 2027, when electronic invoicing becomes mandatory for companies with revenues above €100,000.
A transitional grace period has nevertheless been built in. Penalties will only apply from 2028, leaving the whole of 2027 as a phase-in period to help businesses adjust to the new mechanism.
A dedicated thematic section has been created on the Department of Finance’s website, where the various regulatory and administrative references can be consulted, along with, most importantly, technical manuals covering operating procedures, IT aspects and the data formats to be used.
The documentation relates in particular to electronic invoicing for the exchange of goods and services between San Marino and Italy. Materials available include Delegated Decree No. 163 of 20 September 2021 on electronic invoicing for trade with Italy, Delegated Decree No. 147 of 5 August 2021, Regulation No. 14 of 8 September 2021, and the related technical annexes.
Also available is the San Marino text of the new agreement on the exchange of goods between Italy and San Marino, signed in Rome on 26 May 2021 through an exchange of letters between the Italian Ministry of Finance and San Marino’s Department of Finance and Budget.
It’s not just rules and manuals. The page set up by the Department of Finance also includes a dedicated FAQ section on electronic invoicing, designed to answer operators’ questions, as well as a section collecting video conferences dedicated to the new system.
For businesses and professionals, the operational phase now begins: from 1 October it will be possible to start using the system on a voluntary basis, while from next January the first real obligation kicks in for the group of economic operators above the €100,000 revenue threshold.
