San Marino is moving to electronic invoicing and preparing the gradual phase-out of paper documents. The new rules are set out in Decree No. 27 of the Congress of State (Congresso di Stato), adopted at its session on 1 September.
The change will affect economic operators, agricultural businesses, the State, and public and private entities holding an economic operator code. A first phase will begin on 1 October 2026 and will run until the end of the year on a voluntary basis.
Electronic invoicing will subsequently become mandatory, with an exemption for businesses that recorded revenues below 100,000 euros in the previous calendar year. Penalties for those who, despite being obliged to do so, fail to submit an invoice or submit it late will apply from 1 January 2028.
The new system will run through the Tax Office’s HUB SM platform, to which invoices must be sent electronically. The Office will not be responsible for archiving documents on behalf of operators, but will provide a dedicated area where they can be consulted and retrieved.
Deadlines have also been set. For the sale of goods, invoices must be issued within the second month following delivery or shipment, while for services the deadline will run from their completion. The same deadline will apply to deposits and advance payments, limited to the amount already paid.
