Family Law: new measures take effect as ISS issues first guidelines on accessing benefits

San Marino's Social Security Institute begins issuing circulars explaining how citizens and residents can access benefits under the new Family Law.

San Marino’s new Family Law is entering its operational phase. Following the entry into force of Law no. 141 of 23 September 2026, the Social Security Institute (Istituto per la Sicurezza Sociale, ISS) has begun issuing the first circulars with instructions for citizens, residents and other interested parties on how to access the new benefits and manage the related applications.

The announcement came from the Secretariat of State for Justice, Welfare and the Family. “The Administrative Directorate of the Social Security Institute has begun issuing the first explanatory circulars aimed at providing citizens, residents and interested parties with the guidance needed to access benefits and manage their applications,” the statement reads.

An initial clarification concerns those who had already started the procedures before the new provisions came into force. The Secretariat specifies that “applications already submitted and authorisations already obtained remain valid, and will be automatically aligned — as of 28 September 2026 — with the new regulatory provisions.”

A provision has also been published regarding the adjustment of family allowance amounts starting from October 2026.

At the same time, the new Family Information Point is taking shape, established under the same law within the Technical-Administrative Secretariat Office for Equal Opportunities, Bioethics and Social Inclusion (UPOBIS), at the Tavolucci Office Centre in Borgo Maggiore.

The service, the Secretariat explains, was created “with the aim of helping those entitled to access services and social resources dedicated to families, through information, listening, reception and assistance in submitting their applications.”

The official inauguration will take place shortly, but the office is already operational. For matters concerning the application of the legislation, prestazioni.famiglia@iss.sm is active, under the ISS’s Office for Economic Benefits and Pensions.

“Further circulars and operational guidance will be made available progressively over the coming days through the same institutional channels,” the statement adds.

Another event is scheduled for Thursday, 8 October at 8:00 pm at the Sala Montelupo in Domagnano, where a public evening dedicated to the new Family Law will be held, conceived as an opportunity for information and dialogue with the public.

Commenting on the transition from legislation to implementation, the Secretary of State for Justice, Welfare and the Family, Stefano Canti, said: “The next step after the law’s entry into force concerns its practical usability. Coordination with the ISS is essential so that the new protections are applied in an orderly way to support those entitled to them, making procedures and reference points easier to identify precisely. A policy in support of the family must translate legislative provisions into tools that people can genuinely use in their everyday lives.”
